TERMS & CONDITIONS
Last updated: 13 October 2026
Seller & Scope
These Terms & Conditions govern the use of www.bagouve.com (the “Site”) and purchases made from BAGOUVE S.L. (“Bagouve”, “we”, “us” or “our”). By placing an order, you agree to the terms made available before checkout. Nothing in these terms limits any mandatory consumer rights.
Products & Availability
We aim to present each product accurately, including its main features, size, materials, edition details and price. Colours and textures may appear different depending on your screen. Whilst we take reasonable steps to depict Products as accurately as possible through the photographs and videos featured on the Site, the detailing (such as colour, pattern and texture, etc.) you see on-screen will depend on your monitor and, as such, may not exactly reflect the actual detailing of a Product when you receive it.
Size guides are intended to help you choose; if you need advice, please contact us before ordering. Certain collections are produced in limited quantities. Product availability is subject to stock, and placing an item in your basket does not reserve it. Where an item is offered for pre-order, its estimated dispatch information will be communicated on the relevant product page or before checkout.
Prices, Taxes & Payment
The applicable price is the one displayed when you place your order. Prices include VAT where applicable. Shipping charges, delivery options and any duties or import charges collected at checkout are shown before payment. Additional customs charges may apply for certain destinations; please consult our Shipping & Returns policy.
Payment methods available for your destination are displayed at checkout. Payments are processed securely by the available payment providers, and we do not require customers to pay charges that were not disclosed before completing their purchase.
We may correct typographical or pricing errors on the Site. If an obvious error affects an order before acceptance, we will contact you to offer the option of proceeding at the correct price or cancelling it without charge. Your mandatory rights are unaffected.
Placing an Order
To purchase, select the product and size, add it to your basket, review your details and delivery options, and complete the checkout process. You can correct your order information before confirming payment. The final checkout action will clearly indicate that placing the order involves an obligation to pay.
After you place an order, we send an electronic acknowledgement to the email address supplied. This confirms receipt of your request and provides an order record; acceptance of the sales contract is confirmed when we accept and process the order, normally through a dispatch confirmation. If we cannot fulfil an order, we will inform you and refund any amount already collected without undue delay.
Checkout may be offered in different languages. The contract information and the language applicable to your order are those made available to you during checkout. We retain order records for the periods required by law. If you need a copy of your order confirmation, you can request it from customer support. You should retain your order confirmation and these Terms for your records.
Shipping & Delivery
Orders are generally dispatched from Madrid, Spain. Available delivery services, costs and estimated delivery periods are displayed at checkout or in our Shipping & Returns policy. Estimates may vary with destination, customs processing and periods of high demand.
Unless a different delivery period has been expressly agreed, we will deliver goods without undue delay and in any event within 30 calendar days of the contract being concluded, as required by law. If delivery is delayed, you may have the right to request delivery within an additional reasonable period or terminate the contract in the circumstances provided by law.
When Bagouve arranges delivery, responsibility for loss or damage in transit remains with us until you, or a third party you have designated other than the carrier, takes physical possession of the goods, subject to applicable law. Please contact us if your order is missing, damaged or incorrectly delivered.
Withdrawal & Returns
Consumers entitled to the statutory right of withdrawal may cancel a distance purchase within 14 calendar days after receiving the goods, without giving a reason, subject to the exceptions provided by law. You must inform us of your decision before the deadline. You may do so through our returns portal or by sending a clear statement to support@bagouve.com. A clear statement is sufficient to exercise the withdrawal right; use of the statutory model withdrawal form is optional.
After notifying us, return the products within 14 calendar days. You may examine garments as you would in a shop; you may be responsible for any reduction in value caused by handling beyond what is necessary to establish their nature, characteristics and fit. This does not remove your statutory withdrawal right merely because an original label or package is missing.
For ordinary returns, the disclosed return shipping fees are €5 for Spain, €10 for the rest of the EU and €30 for destinations outside the EU, unless Bagouve bears the cost or the law requires otherwise. These costs may be deducted from the refund where legally permitted. We recommend using the returns portal so that your parcel can be correctly identified and tracked.
Refunds & Exchanges
When a full order is returned under a statutory withdrawal right, the refund includes the price of the goods and the original standard delivery charge as required by law; additional amounts paid for premium or express delivery need not be refunded, except where required by law. For partial returns, original delivery charges are generally non-refundable unless applicable law provides otherwise.
Any refund due following statutory withdrawal will be made without undue delay and within the legal time limit, normally within 14 days of our being informed of the withdrawal. We may withhold payment until we receive the goods or proof of their return, whichever happens first. Refunds are made through the original payment method unless you expressly agree otherwise, at no additional cost to you.
Size exchanges are free in both directions: we cover the cost of returning the original item and sending the replacement size, subject to stock availability. Exchanges for another product may be subject to the usual return fees and any price difference. Further practical information, including optional store credit, is available in Shipping & Returns.
Faulty Goods & Legal Guarantee
Products must conform to the sales contract and the information provided before purchase. If an item arrives incorrect, damaged or defective, please contact support@bagouve.com with your order number and, where possible, photographs so we can assist promptly. Where Bagouve is legally responsible for a non-conforming item, you will not be charged for the necessary return, repair or replacement shipping.
Under Spanish consumer law, the statutory period of liability for lack of conformity of new goods is generally three years from delivery. Depending on the circumstances and legal requirements, you may be entitled to repair, replacement, a proportionate price reduction or termination of the contract. These remedies are provided without the costs prohibited by law. Mandatory protections available in your country of habitual residence remain unaffected.
Customer Accounts & Site Use
You may browse the Site without creating an account unless a specific feature requires one. If you create an account, you are responsible for keeping access credentials secure and for providing accurate information. Please notify us if you suspect unauthorised access.
You must use the Site lawfully and must not interfere with its security, attempt unauthorised access, introduce malicious code or use automated tools in a manner that harms the Site or infringes applicable law or the rights of others. Lawful indexing, linking and any use permitted by mandatory law are not prohibited by these terms.
Intellectual Property
Unless otherwise indicated, the names, trademarks, designs, text, photographs, artwork, graphics and other content published on the Site belong to Bagouve or the respective rights holders and licensors. Some collections feature licensed works or collaborations with artists, galleries and institutions.
You may view and save content for personal, lawful and non-commercial use. You may not reproduce, sell, distribute, adapt or commercially exploit protected content without the relevant rights holder's permission, except to the extent permitted by law. Purchasing a product does not transfer intellectual property rights in its artwork or design.
Website Content & External Links
We aim to keep the Site accurate, secure and available, but occasionally it may be unavailable for maintenance or technical reasons. We may update content, design or services without affecting orders already accepted or your statutory rights. General editorial information on the Site is not professional advice.
The Site may contain links to third-party websites. Those sites are operated under their own terms and privacy practices. We are not responsible for third-party content or services outside our control, except where applicable law provides otherwise.
Privacy & Cookies
We process personal data in connection with orders, accounts, customer service and other activities as described in our Privacy Policy. The Site may use cookies and similar technologies, subject to the information and choices provided through our privacy and cookie settings and applicable law.
Liability & Consumer Rights
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including your statutory rights relating to product conformity, delivery and withdrawal, or liability for fraud or other matters that cannot be excluded under applicable law.
Where permitted by law, Bagouve is not responsible for losses caused exclusively by circumstances outside our reasonable control or by improper use of the Site. Any such limitation applies only to the extent allowed by law and does not affect mandatory remedies available to consumers.
Applicable Law & Disputes
These Terms are governed by Spanish law, without depriving consumers habitually resident in another country of any mandatory consumer protections provided by the law of that country where applicable. Disputes may be brought before the courts competent under applicable consumer-protection and jurisdiction rules; you are not required to submit exclusively to courts in Spain where the law gives you another option.
If you have a complaint, please contact us first so we can seek a resolution. You may also contact the consumer advice or alternative dispute resolution services available under applicable law.
Changes & Contact
We may update these Terms to reflect legal or operational changes. The version applicable to an accepted order is the version made available when that order was placed, unless changes are required by law. Material changes will not retroactively remove rights already acquired.
For questions about these Terms, products or orders, contact support@bagouve.com or write to BAGOUVE S.L., Calle de las Platerías 5 (1º B), 28016 Madrid, Spain.
